Terms and conditions of sale

General

The general terms and conditions of sale apply to all TéléCharmey SA products and services.

tickets and subscriptions

VALIDITY

Tickets and season tickets are personal and non-transferable. They are only valid during operating hours.

Loss or theft

If a ticket or season ticket is lost or stolen, it is replaced once on presentation of the purchase receipt. If the purchase cannot be justified, the user must pay for a new pass.

Misuse / counterfeiting

Misused or counterfeit tickets and season tickets will be confiscated. The user must pay compensation of CHF 150 for each day of fraud, subject to civil or criminal law measures.

Exchange / refund

Tickets and season tickets purchased cannot be exchanged for other tickets or season tickets at a later date. If operations are suspended in whole or in part due to bad weather or force majeure (e.g. avalanche danger), the customer is not entitled to any refund.

TRANSPORT EXCLUSION

GENERAL

Persons may be excluded from transport if they

  • are intoxicated or under the influence of narcotics ;
  • behave in an inappropriate manner;
  • fail to comply with regulations governing the use of means of transport or passenger behaviour, or fail to comply with staff injunctions based thereon.

Transport for the purpose of practicing a sport

If weather conditions are unfavorable, people may be excluded from sport transportation. In addition, people may be excluded from sport transportation if they endanger third parties immediately prior to scheduled transportation, if there are reasons to believe that they will continue to endanger third parties, or if they fail to respect the property of others. Non-respect of others is deemed to have occurred when the person concerned has disregarded a hiking, mountain biking or downhill scooter route and gone off the marked trails. In the event of a repeat offence or in serious cases, the ticket or season ticket may be confiscated. Endangerment of third parties is deemed to have occurred, for example, when the person concerned

  • has behaved indelicately ;
  • has travelled on a slope exposed to avalanche danger;
  • has disregarded safety signs and prohibitions;
  • disobeyed safety instructions issued by the avalanche control and rescue service.

Booked activities

  • Booked activities (courses at ESS Charmey, Vallée des Tyroliennes, etc.) can be cancelled/moved free of charge 48 hours in advance. If notice is given less than 48 hours in advance, the activity will not be refunded or moved under any circumstances.
  • If you have taken out cancellation insurance for courses at ESS, reimbursement will be made in accordance with the insurance conditions.

Responsibility

To the extent permitted, TéléCharmey SA's liability is limited to negligent and intentional conduct on its part.

Rescue service

TéléCharmey SA provides a rescue service during the winter. In the event of an accident on the ski area and the need to call in the rescue service, the customer may be billed for the costs incurred. Third-party costs (e.g. Rega, doctor) are borne directly by the customer. Any claims for reimbursement must be submitted to the customer's insurance company.

Applicable law / place of jurisdiction

The contract between the customer and TéléCharmey SA is governed by Swiss law, with Bulle as the place of jurisdiction, unless mandatory legal provisions stipulate otherwise.
